Introduction
The Lamsah Application is a platform of easy and speedy use for reservation of appointment in salons and beatification clinics in the K.S.A. The application browser can identify the available services and offers and vacant times and evaluation of work quality. Also, it is possible to determine the requiredservices by few steps so as to save the time and effort.
Through loading the application and access to the information, resources, products and tools that we present through the service providers, you agree on acceptance and compliance with following terms and conditions:
Article One /Personal Information:
For purpose of access to the application, there may be need to present some of your personal information such as:
● Name
● Date of birth
● Determination of ID Card or mobile number or mail as part of the process of registration and your ability to use the application.
You agree that any information you present will always be accurate, correct and updated and you will be responsible for its correctness in general.
Article Two/ Privacy Policy:
1/The Policy
The Lamsah Application respects the privacy of the users and is obliged to protect that privacy, when the users visit the electronic services of the application they should agree on the terms stated in this policy. Therefore, we kindly request you to read the following “Privacy Policy “so you can know the manner of collection and use of the information.
2/Collection of Information
Some unspecified information is collected for the person automatically during the use of our electronic application on the smart phones such as:
● Address of Internet Protocol that you use in the access.
● Type of Internet Browsers that you use and time and date of the visit.
● The services and pages that you check on our electronic application.
● The geographical location in which you exit during your browsing our electronic site.
The specified information of the person is collected voluntary when the user makes any of the following:
● Sending his personal information such as the name, date of birth and email address.
● Writing of suggestion or complaint through Internet, by filling up the relevant form.
● Using the electronic service through the application and any other electronic services on the application.
● Keeping the users’ record registered on the electronic application.
● Those information permit us to assign the services in accordance with selections of the users.
● Collection of the statistical information that enable us to render the best services to be able to communicate with the users and to present the new services on the platform.
The private information of the users is absolutely not shared with any other party except the service providers for completion of the process of reservation unless the information is required by legal order.
3/Interactive Software (Cookies)
The Interactive software (Cookies) is used for specifying the properties of the user’s visit and furthering the experiment of the use of the application. The preparation of most Internet browsers can be used in rejection of the Interactive softwares (Cookies) or its acceptance or deletion.
In case the Lamsah Application is connected with another site we urge the users to read the privacy policy of every site of owners of indicated electronic sites before presenting any personal information on any electronic site that they access through the links in the application.
4/Information Security Control Rules:
● The Lamsah Application implements the necessarycontrols for protection of privacy of the personal information presented by the user.
● The suitable encryption methods is used for protection of the information which is deemed sensitive and important and any information must be protected in accordance with regular and legal requirements.
5/The Amendments:
The Lamsah Application reserves its right to update or amend the privacy policy at any time. However, the date of its effectiveness shall be put at the beginning of the policy and the user must review the privacy in a regular manner for identifying the new policies prescribed by the application.
Article Three /General Conditions:
● Non penetration of the confidential registration information and data having connection with any account to be used for access to the application.
● Making sure of non access to our application through other means except through the methods we present in a legal manner.
● Observing the non access to any other activity that delay our application or conflict with it.
● It is prevented to copy or repeat or re-produce or sale of trading or resale of the application
● The user bears the complete responsibility when the application is exposed to burdens or losses or damages, directly or indirectly, by reason of carrying out any unauthorized activities.
● The user is responsible for any illegal or threatening or defaming or abusive or disturbing or contempting or fraudulent or cheating or racial representations or that contains any kind of suggestive or non appropriate or express language in violation of the public feeling.
● You are personally responsible to use the open communication tools in a responsible and moral manner, through publishing the information under your personal responsibility. We will monitor the content published by the users through the various communication tools.
● None violating the trade mark or patent or trading secret or copyrights or right of ownership of any other party.
● None taking the personality of any person or entity including any employees or representatives of LamsahApplication.
● The user is responsible for compensation and non-harmingthe Lamsah Application and all application team from and against all losses, expenses , damages, costs and charges resulting from any violation to this user’s agreement or non fulfilling any obligations relating to your account incurred by you or any other person using your account .
● We are entitled, as per our absolute discretion, to remove any content not compatible with this user’s agreement andalso any abusive or harmful or non acceptable or non accurate content.
● We are not responsible for any delay or failure in removal of the content. If you publish any content that we choose to remove it, you agree for such removal and also agree to waive any claim against us.
● Also, we are entitled to take any legal action in case of any violation for the terms and conditions and claims of compensation.
● Also, we reserve the right to handle the exclusive defense for any claim by which we are entitled to get compensation under this user’s agreement and in case of occurrence thereof you must provide us such cooperation as required by us in a reasonable manner.
Article Four/terms & Conditions for intellectual property rights and publishing/trade marks.
● All contents and materials available at Lamsah Application including the text and drawings, name of the site, the emblem, pictures and emblems are protected under the Regulations and Laws of Intellectual Property of LamsahApplication and also protected under the copyrights and valid and applicable law of the trade marks.
● Any unauthorized use including , but not limited to , re-production or distribution or presentation or transfer of any content for this application is absolutely prohibited unless there is written permission from concerned body specifically from the management and officers of the application .
● The user may print the content or loading or sharing it only if it is for personal purpose (the use) and not for anytrading use.
Article Five / Terms & Conditions upon reservation of appointment and cancellation:
● Any user may see the content and pictures and all information of the service providers of saloons,beautification centers and clinics and others from the women beautification services providers after the user is registered through the Lamsah Application.
● Upon reservation through the application you accepts the privacy policy and contractual relationship conditions with the service provider as a whole.
● The information of reservation will be shown too you completely in the application at the “coming timing”.
● You will receive a notice message in the mobile before the specific appointment.
● You can communicate with the service provider by opening of Chat after the application for the service or using one of the available communication channels.
● The payment of the amount required for the service will be completely and directly at the service provider or through the payment channels in the Application. We are not responsible for the credibility of those prices.
● You can cancel the confirmed reservation before the time stipulated when booking, through the application, and the amount will be credited to the same payment channel used which will might take 3-5 working days. And in Lamsahapplication, we have the right to impose a fine, which is a percentage of the value of the reservation that will be stated before booking the appointment, when the appointment is not canceled on time or for non-attendance appointment
● For non-attendance the appointment the amount will be credited to the same payment channel used which will might take 3-5 working days. And in Lamsah application, we have the right to impose a fine, which is a percentage of the value of the reservation that will be stated before booking the appointment
● If the appointment is canceled by the service provider, the amount will be credited to the same payment channel used which will might take 3-5 working days
● Lamsah has the right to cancel the account of any user without any notice in the following cases:
o In the event that the confirmed reservation is not canceled before the time stipulated at the time of reservation or failure to appear on the specified date for obtaining the service for more than 3 times within one month, the account will be canceled and blocked and you will not be able to make any other reservations. Please contact us if you wish to reactivate the account again with reasons.
● The customer should attend before the specific appointment by at least ten minutes. The service provide is entitled to cancel the reservation or non rendering the required service or rendering the service at a time less than what is prescribed in the application in case of non compliance with the specific timing.
● The service provider is entitled to use the direct contact with the customer (specially the Chat-Mobile-Email) after making of the reservation in case of necessity of discussing the details or the reservation or the required service.
Credit cards or banking transfer or payment through wallet
● The third partner the service provides makes available the payment through the credit cards/ approved withdrawal for paying the cost of the rendered service in accordance with policy of payment of each service provider through safe means of payment via internet as per extent presented and supported by your relevant bank.
● Payment will be made after booking through the application either by cash (cash) at the service provider or securely via your credit / debit card to the service provider's bank account through the approved payment port at the service provider
● or the amount of the service will be reserved on the credit card when booking from the application, and the amount will be withdrawn after providing the service through the approved payment port to Lamsah bank account.
● Lamsah application allows the payment feature for reservations through the wallet, through which you can collect points and receive the money provided as a gift
● Upon making of reservation for any of the offered services, please verify the full details of the service and the required conditions before applying for the service and performance of the reservation.
● In case of occurrence of fraud or unauthorized use for your credit card by third parties having no relation with the Lamsah Application or partners of the Application ( service providers) , most of the banks and credit cards companies bear the risks as they cover all consequences resulting from such fraud or misuse . Please make sure of sending the fraud report to your credit card provider in accordance with rules and procedures concerning the presentation of the reports and immediately contacting us and provide an evidence to us about the deducted amount and the fraud. This action is only applicable for theconfirmed reservations made by credit card by use of our site safe servers.
Article Six /Terms & conditions for evaluation of services rendered to the customers:
● Any customer, through the Lamsah Application, is permitted to evaluate the services rendered to him after completion of the service and its obtaining.
● The evaluation depends on writing a comment on the service and selection of (stars) so that after it a rate can be counted for all evaluations given to the services of the Saloon by real customers who actually tested those services.
● All evaluations will be put under the name of each service provider on the Application so that all potential customers would know the extent of the quality and level of the rendered service
Article Seven /terms & Conditions of compensations & claims:
● In case there is any problem relating to the service rendered by the service providers, you are entitled to present a claim or compensation to be agreed between you and the service providers directly and at the same time of your existence at the service provider. However, you are not entitled to claim us any compensation of whatsoever kind.
● Also, you can communicate with the customer’s service department in case there is any remarks on the service providers. We will exert our utmost effort for assisting in finding a suitable solution for all parties without any responsibility on us.
Article Eight / Terms & Conditions of guarantees:
The Lamsah Application is deemed as marketing and advertising mediator between the service providers and the customers. So, we guarantee the following for you:
● The use of our application will meet your needs or requirements in a whole guaranteed manner.
● The use of the application will be suitable, without interruption, for your time or place and it is safe and free from errors.
● The information to be obtained by use of the application will be accurate or reliable whereas all of it comes through the service providers but we do not guarantee that it is free of any defects especially in relation to the prices whereas its updating will be under the responsibility of the serviceproviders only.
● Any defects in operation of the application or one of its functions, and in case of occurrence of same we will work for its repair or correction as quickly as possible.
Article Nine / Terms & Conditions for determination of responsibility:
● The Lamsah Application does not take any additional amounts from the customers (the users of the application) for making of reservations.
● The Lamsah Application is not responsible for any loss direct or indirect or consequential or typical or damages that you may incur as a result of using our application and we will not bear any responsibility whatsoever for the service rendered by the partners.
● The Lamsah Application will not bear any responsibility whatsoever for the payment gates and the customer declares that he is aware that the payment gate is subject to the company’s management that renders the payment service.
● The management of Lamsah Application will not bear the responsibility for non accuracy of the content resulting from the application directly by the partner the service provider.
● Also, it is not within the jobs of the Lamsah Application to monitor the accuracy of the content which the partner the service provider presents and that the partner the service provider is responsible for presentation of the information and prices to the Application Management as the content may contain some mistakes in the materials and /or printing for which the Lamsah Application will not bear any responsibility.
● The Lamsah Application reserves its right to terminate the accounts that are not active for a long period of time.
● The Lamsah Application reserves its right to amend or stop the application temporarily or permanently ( wholly or partially) by notice or without notice and the user agrees that the Lamsah Application will not bear any responsibility for you or for third party for any amendment or stop or discontinuance of the service .
● The prices of the services, to be presented on the page of the partner on the application, may be updated from time to time based on the exclusive decision of the partner who provides the service.
Article Ten /Terms & Conditions for transfer of ownership:
The Lamsah Application may assign or transfer all rights and duties arising under this agreement by any way and for the reason it thinks suitable, to any legal body, at present or in future, of whatsoever shape, of whose supervision it is subject or in case it amends its legal entity to the new company that would be formed on effect of such amendment. You will be notified of such transfer or change that occurs to the legal entity of the Lamsah Application that may not affect, in any of the shapes, your rights and duties arising of this agreement. You are not entitled to assign or transfer the ownership of any rights of the Lamsah Application or delegate any of its duties under this agreement, wholly or partially (including the way of merger or power of law) without its prior written approval. If the duties are transmitted or its ownership is transferred or delegated by the way permitted under these terms, such terms shall be deemed binding for all of your assigned heirs (including any assignee or transferee for all assets belonging to you and any heirs through the merger or by operation of law).
Article Eleven / Terms & Conditions of end of the use
You agree that we are permitted, as per our special discretion,to suspend or end your access to the Lamsah Application with or without notice and for any reason in case of violation of this user’s agreement, or practicing of any activity suspected to be illegal or fraudulent or abusive that may be a reason for ending your relationship that may be referred to the competent Legal Authorities in the KSA. Upon the suspension or termination your right will be stopped immediately for using the platform that we offer. We reserve the right to remove or delete any information that you may have in a file with us including any account or information of registration of the access.
Article Twelve / Terms & Conditions for notice of trade mark rights:
The Lamsah Application includes trademarks, trade names, trading appearance and service names and scope names and other signs of ownership( all referred to as the “ marks”) owned by us or we are licensed to use it . You have to agree , except in cases referred to in a supplement to be added to this agreement, that no right or ownership or license or permit or interest of any kind relating to these marks to be given to you or transferred to you or you obtain it or meant to be given to you or transferred to you or you obtain it as a result of execution of this agreement, or part of it or its implementation or non implementation , you are absolutely prohibited to challenge or deny the validity of our right of ownership of the marks or license of its use and also you are prohibited to encourage or support the others , whether directly or indirectly, to do the same throughout the validity period of this agreement and after expiry of such period. Also, you are prohibited to use the marks by any means that may lessen its value or damage its reputation. Also, you are prohibited to use or register name of scope similar or typical to any of the marks.
Article Thirteen / Mechanism of settlement of disputes and applicable law:
This Application shall be controlled by the LamsahApplication Management located at the KSA, Eastern Province. The Application can be accessed by all countries in all of the world. And whereas every country has laws that may differ of the laws of the KSA, you agree, through the access to our Application, that the regulations and laws valid in the KSA, regardless of the conflict or difference of the laws in other countries, shall be applicable for all matters relating to the use of this site and use or reservation of any of the products or services through this site or application.
Furthermore, any action for enforcement of this user’s agreement shall be filed in the courts available in the KSA, on condition that you agree to submit to the personal jurisdiction of such courts and to waive any judicial or locational on non appropriate objection for such courts.
